Terms of service
1. Scope
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between UPRAIL GmbH, trading as “People’s Store” (hereinafter “we” or “us”), and consumers via our online shop at www.peoplesstore.de. The version valid at the time of the order applies.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(3) Conflicting or deviating terms and conditions of the customer do not apply unless we have expressly agreed to their validity.
2. Contracting party and customer service
Your contracting party is:
UPRAIL GmbH
Richard-Byrd-Straße 12
50829 Cologne
Germany
Commercial Register: Amtsgericht Köln, HRB 79632
You can reach our customer service by e-mail at mail@uprail.de or by telephone at +49 (0)221 500057-20.
3. Conclusion of the contract
(1) The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) Ordering process: You add the desired products to your shopping cart using the corresponding button (e.g. “Add to cart”). In the shopping cart you can change quantities or remove products. You then proceed to the checkout, where you enter your contact details and delivery address and choose the shipping method (or pickup) and the payment method. For some payment methods (e.g. PayPal or Klarna), you will be redirected to the payment provider during the ordering process. Before submitting your order, you will see an overview of all details of your order. By clicking the final order button (e.g. “Pay now”), you submit a binding offer to purchase the goods contained in your shopping cart.
(3) Correcting input errors: Before submitting your order, you can check all entries in the shopping cart and in the checkout at any time and correct them using the input fields, the usual keyboard and mouse functions or the links to the previous steps. You can cancel the ordering process at any time by closing the browser window.
(4) We will confirm receipt of your order by e-mail without undue delay (order confirmation). The contract is concluded when we accept your order by sending this order confirmation or by dispatching the goods, whichever occurs first.
(5) Contract languages: The contract can be concluded in German, English, French and Polish.
(6) Storage of the contract text: We store the text of the contract (your order data and the GTC valid at the time of the order). You will receive your order data, these GTC and our withdrawal instructions by e-mail with the order confirmation. You can view and print these GTC at any time on this page. If you have a customer account, you can also view your orders there.
4. Prices and shipping costs
(1) The prices shown in our online shop are final prices and include the statutory value added tax.
(2) Shipping costs are charged in addition. They depend on the destination and the type of product and are shown on our Shipping & Delivery page and in the checkout before you submit your order.
(3) For deliveries to countries outside the European Union (e.g. Switzerland or Norway), customs duties, import taxes and fees may be charged on import. These are to be paid by the customer unless otherwise stated in the checkout.
5. Payment
(1) We offer the following payment methods: PayPal, credit card (including Apple Pay and Google Pay), Klarna, prepayment by bank transfer and cash payment on pickup in our store in Cologne. The payment methods available for your order are shown in the checkout. We reserve the right to exclude individual payment methods in individual cases.
(2) Unless a later due date has been agreed for the chosen payment method (e.g. with Klarna or cash payment on pickup), the purchase price is due upon conclusion of the contract.
(3) Prepayment: Please transfer the total amount to the bank account stated after completion of your order and on our Payment page, quoting your order number as the payment reference. We will process and ship your order after receipt of payment.
(4) PayPal, credit card, Apple Pay and Google Pay: The payment is processed by the respective payment service provider. When paying with PayPal, PayPal’s terms of use also apply.
(5) Klarna: If you choose a Klarna payment option, the payment is processed by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. The Klarna payment options available to you and Klarna’s terms are shown in the checkout. Klarna may carry out an identity and credit check.
(6) Cash payment on pickup: If you select “Pickup”, you can pay the purchase price in cash when you collect your order in our store in Cologne (People’s Store Cologne, Eigelstein 76, 50668 Cologne, Germany). We will let you know when your order is ready for pickup.
6. Delivery, delivery times and pickup
(1) We deliver to the countries listed on our Shipping & Delivery page. Delivery is made to the delivery address provided in the checkout.
(2) The delivery time stated for the respective product or on our Shipping & Delivery page applies. Unless otherwise stated, the delivery time begins, for prepayment, on the day after you instruct your bank to make the transfer and, for all other payment methods, on the day after conclusion of the contract. It ends on expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday or a public holiday recognised at the place of delivery, the period ends on the next working day.
(3) If delivery fails because the customer has provided incorrect address details or because delivery attempts fail, we may charge the customer for the resulting additional costs, unless the customer is not responsible for this.
(4) Pickup: You can select “Pickup” in the checkout and collect your order from our store: People’s Store Cologne, Eigelstein 76, 50668 Cologne, Germany.
(5) The risk of accidental loss and accidental deterioration of the goods passes to you upon handover of the goods to you or to a person authorised to receive them.
7. Pre-orders
Products marked as pre-order items can be ordered before they are available. Our Purchase Options Policy applies in addition.
8. Retention of title
The goods remain our property until full payment has been received.
9. Right of withdrawal
Consumers have a statutory right of withdrawal. Details, including the model withdrawal form and our online withdrawal function, can be found in our Withdrawal Policy. For orders delivered to Switzerland, we grant a voluntary return right, which is also described there.
10. Warranty and guarantees
(1) The statutory warranty rights (liability for defects) apply.
(2) Information on any additional guarantees and their conditions can be found with the respective product or in the guarantee terms of the manufacturer. Guarantees do not limit your statutory warranty rights.
11. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, insofar as we have given a guarantee, and in the event of fraudulent concealment of a defect.
(2) In the event of slight negligence, we are only liable for the breach of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In this case, our liability is limited to the foreseeable damage typical for this type of contract.
(3) The above limitations of liability also apply in favour of our legal representatives and vicarious agents.
12. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
14. Final provisions
If individual provisions of these GTC are or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions apply in place of the invalid provisions.
